FOR HOW LONG ARE PERSONAL DATA RETAINED?

Legal Basis:

The processing of your data is carried out based on the following legal grounds that legitimize it:

In cases where the user includes files with personal data on the shared hosting servers, Baon Partners, S.L is not responsible for the user’s non-compliance with the GDPR.

Intellectual Property of Software:

The user must respect the third-party programs made available by Baon Partners, S.L, even if they are free and/or publicly available.

Baon Partners, S.L holds the necessary exploitation and intellectual property rights for the software.

The user does not acquire any rights or licenses over the software necessary for the provision of the service, nor over the technical information for the monitoring of the service, except for the rights and licenses necessary to fulfill the contracted services and only during the duration thereof.

For any action that exceeds the fulfillment of the contract, the user will need written authorization from Baon Partners, S.L, and it is forbidden for the user to access, modify, or view the configuration, structure, and files of the servers owned by Baon Partners, S.L. The user will assume civil and criminal liability for any incident that may occur on the servers and security systems as a direct consequence of a negligent or malicious action on their part.

Intellectual Property of Hosted Content:

The use of services provided by Baon Partners, S.L contrary to intellectual property laws is prohibited, specifically:

1. Use that is contrary to Spanish law or that infringes the rights of third parties.
   
   
2. The publication or transmission of any content that, in the judgment of Baon Partners, S.L, is violent, obscene, abusive, illegal, racist, xenophobic, or defamatory.
   
   
3. Cracks, program serial numbers, or any other content that infringes the intellectual property rights of third parties.
   
   
4. The collection and/or use of personal data of other users without their express consent or in violation of the provisions of Regulation (EU) 2016/679 of the European Parliament and of the Council, of 27 April 2016, on the protection of natural persons concerning the processing of personal data and on the free movement of such data.
   
   
5. The use of the domain’s mail server and email addresses for sending unsolicited mass mailings.

The user is fully responsible for the content of their website, the information transmitted and stored, hypertext links, third-party claims, and legal actions related to intellectual property, third-party rights, and child protection.

The user is responsible for compliance with applicable laws and regulations and the rules related to the operation of the online service, electronic commerce, copyright, public order maintenance, as well as universal principles of Internet use.

The user will indemnify Baon Partners, S.L for any expenses generated by Baon Partners, S.L’s involvement in any case for which the user is responsible, including legal fees and expenses, even in the event of a non-final judicial decision.

Protection of Stored Information:

Baon Partners, S.L makes backup copies of the contents stored on its servers; however, it is not responsible for the accidental loss or deletion of data by users. Similarly, it does not guarantee the complete restoration of deleted data, as such data may have been deleted and/or modified during the time elapsed since the last backup.

The services offered, except for specific backup services, do not include the restoration of contents stored in the backup copies made by Baon Partners, S.L, when such loss is attributable to the user; in this case, a fee will be determined according to the complexity and volume of recovery, always with prior acceptance by the user.

The restoration of deleted data is only included in the service price when the loss of content is due to causes attributable to Baon Partners, S.L.

Commercial Communications:

In compliance with the LSSI, Baon Partners, S.L will not send advertising or promotional communications by email or other equivalent electronic means that have not been previously requested or expressly authorized by the recipients.

In the case of users with whom there is a prior contractual relationship, Baon Partners, S.L is authorized to send commercial communications related to products or services of Baon Partners, S.L that are similar to those initially contracted by the client.

In any case, the user may, after proving their identity, request not to receive more commercial information through the Customer Service channels.
